Terms and Conditions
These Terms and Conditions apply to the
provision by Kalaam Telecom Bahrain B.S.C.(c) (“Kalaam”) of the K-Talk prepaid
calling services (the “Services”) through international calling cards (“Calling
Cards”) issued by and sold through Kalaam’s authorized distributors at certain
specified charges (“Charges”) determined by Kalaam from time to time, and to
countries or locations (“Destinations”) designated by Kalaam from time to time.
By purchasing a Calling Card, the customer (the “Customer”) acknowledges and
agrees to abide by these Terms and Conditions.

1. Services
Calling Cards once purchased shall not be
refunded nor exchanged except where the Services are permanently suspended by
Kalaam. Calling Cards shall be valid for a period of sixty (60) days from the
date they are first used by the Customer. Expiration of any unused credit
balance remaining on the Calling Card shall be the sole responsibility of the
Customer and Kalaam accepts no liability in this regard. Instructions for using
the Calling Card and customer service numbers appear on the Calling Card
itself. The Customer is responsible for the safekeeping of each unique personal
identification number (PIN) printed on each Calling Card. Kalaam accepts no
liability for unauthorized use or theft of the PIN. Access numbers listed on
each Calling Cards are toll-free numbers.
2. Charges
Charges are incurred as soon as
the call made to the Destination is answered. Once the credit balance on the
Calling Card is used up, the current call will be immediately terminated.
Kalaam accepts no liability in this regard.
a. The minutes advertised for
calling cards per BD are subject to change without notice
b. The advertised rate for our calling cards
is for a single call, using up the entire amount on a new card.
Kalaam reserves the right to charge a surcharge of up to 25% on any
subsequent calls on the same card depending on the destination
3. Quality
Kalaam accepts no liability for
the quality of the Service as this may vary depending on the destination
called.
4. Limitation of Liability
Kalaam shall not be liable to the Customer in
any manner whatsoever for consequential, indirect or special damages or for
loss of profit, nor shall it be otherwise liable to the Customer except in
circumstances directly resulting from Kalaam’s gross negligence or willful
misconduct. In no event shall Kalaam’s monetary liability exceed the value of
the Services being provided to the Customer at the relevant time. Kalaam shall
not be liable to the Customer in any manner whatsoever if it is unable to
perform any obligation to provide the Services because of any Force Majeure
Event. “Force Majeure Event” means any act of God, fire, extreme weather
conditions, industrial action, default or failure of a third party, war, act of
government or state, terrorist acts, civil commotion, insurrection or embargo,
and any other event or circumstance beyond the control of Kalaam. All
warranties whether express or implied that are not included under these Terms
and Conditions are hereby excluded to the fullest extent permissible by law.
